Asset Reunification

  1. Introduction

    This reunification service (“the Service”) is a voluntary service operated by AssetTrace+ (“AssetTrace+” or “us”). AssetTrace+ is a trading name for Link Market Services Limited, a company registered in England with registered number 2605568 having its registered office at Central Square, 29 Wellington Street, Leeds, LS1 4DL. The Service is designed to reunite you with assets (for example, unclaimed dividends or shares) held on your behalf by a company in which you are or were a shareholder (“Company”) and may include us undertaking tracing activity using a third-party provider. If you decide not to use the Service, you may contact the Company’s registrar team at Link Group (“Company Registrar”) directly to claim your assets – details can be found on the Company’s corporate website. Different fees apply if you claim your outstanding assets from the Company Registrar directly.

    AssetTrace+ reserves the right to terminate the Service or to vary these Terms & Conditions, with notice where practicable. Your use of the Service will constitute your agreement to be legally bound by these Terms & Conditions. These Terms & Conditions, together with any claim form or online application that you make, create a legally binding contract between you and AssetTrace+.

  2. Claiming your entitlement

    On signing the claim form or filling out the online application, you are appointing and authorise us to:
    1. make a claim (“Claim”) on your behalf for entitlements which appear to be due to you;
    2. update your details on the Company’s register of members where you have provided us with new details (e.g. a new address, or name);
    3. update your bank account details (if applicable) on the Company’s register of members and authorise the Registrar and the Company to make any future dividend payments to such bank account; and
    4. deduct our administration and/or other fees from your cash entitlement (see Section 5).
    Please note that the online service (as opposed to the paper claim form service) is only available to individuals resident in the United Kingdom and who are the registered owner of the unclaimed assets. If you are a corporate, partnership or resident abroad, have changed your name or are claiming the entitlement on behalf of someone else (e.g. as an executor or attorney), please use the paper claim form service (see Section 3).

    The Service may include us undertaking tracing activity using a third-party provider. In such circumstances, if you make a claim, we retain the right to request that you provide proof of your current address and previous address(es).

  3. Paper Claim Form

    If you have been provided with a claim form, to claim your entitlement, please:
    1. complete and date the claim form, ensure that it is signed by all joint shareholders (if appropriate); and
    2. provide photographic proof of identity (a copy of your driving licence or passport) and proof of address (a copy of a bank statement dated within 3 months) of the sole or first named shareholder.
    In order to process your Claim, we need to receive your claim form before the deadline specified in the communication sent by us.

    In the event that you are making a Claim on behalf of a deceased person, please contact us using the details shown overleaf and quoting the claim reference. We will inform the Company Registrar who will contact you with further information on what to do next.

    Changes of Name

    In respect of a change of name, we will need to see an original/certified copy of the Marriage Certificate, Deed Poll, Statutory Declaration, or other similar legal document confirming the change.

    With regard to a divorce, we will need to see an original/certified copy of the Decree Absolute and, if applicable, a Birth Certificate showing your maiden name.

    In certain circumstances we retain the right to request that you provide additional proof of your identity, current address and previous address(es).

  4. Online Application

    If you have received a direction to complete your claim online, to claim your entitlement, please complete the online application. You must submit your claim prior to the deadline specified in any communication sent by us. You may also be able to claim your entitlement by calling our helpline at the number set out in the letter sent to you and in Section 8(b).

    If you complete the application online or via the helpline and you are a joint shareholder, you confirm that you have the required authority and consent from the other joint shareholder(s) to sign on behalf of them and you indemnify AssetTrace+ for any losses arising out of or in connection with you not having the requisite authority from the other joint shareholder(s).

    Online Verification

    We use a third-party provider, Experian Credit Bureau (“ECB”), to verify your identity and bank account details. When you use this online service to claim your entitlement:
    • A search will be carried out with Experian Ltd for the purposes of verifying your identity and account details;
    • ECB may check the details you supply against any particulars on any database (public or otherwise) to which they (ECB) have access in order to verify your identity; and
    • ECB will retain a record of the search.
    In certain circumstances we retain the right to request that you provide additional proof of your identity, current address and previous address(es).

  5. Fees

    We will charge you an administration fee for the Service which will be detailed on the claim form or online application prior to completing your claim. Other fees, levies and taxes may exist which are not imposed or collected by AssetTrace+ and we will not be liable for informing you of any such costs.

    The fee in respect of providing the Service and any other fees will be deducted from your cash entitlement.
  6. Limitation of Liability

    The liability of AssetTrace+ shall be limited to any losses directly associated with the act or omission that gave rise to the liability. AssetTrace+ will not be liable for any damage or loss suffered by you which AssetTrace+ could not reasonably have foreseen. In any event, the aggregate liability of AssetTrace+ or its directors, officers or employees under these Terms & Conditions for any damage or other loss howsoever caused arising out of or in connection with these Terms & Conditions or in connection with your Claim will be limited to the amount of £25,000.

    AssetTrace+ does not represent or warrant that you have a right to any assets. You agree that you have independently verified the facts and assured yourself that you do have a valid Claim. AssetTrace+ is not responsible for the acceptance or rejection of any Claim or payment of any entitlement to you by the Company or the registrar team.

    Notwithstanding anything to the contrary in these Terms & Conditions, neither AssetTrace+ or its directors, officers or employees shall have any liability of any type, for any special or incidental loss or damages, loss of profits, opportunity or goodwill, loss of reputation in connection with or arising out of these Terms & Conditions or in connection with your Claim.

    AssetTrace+ shall not be liable for acting upon any instructions which are forged or fraudulent and shall be entitled to assume that all instructions are genuine provided that AssetTrace+ has acted with all due care in accepting those instructions.

    Nothing in these Terms & Conditions excludes or limits our liability for death or personal injury caused by AssetTrace+’s negligence, for fraud or any other liability which cannot be excluded by law.

  7. Data Protection

    For the purposes of operating this service, AssetTrace+ will collect, process and transfer information relating to you in accordance with AssetTrace+’s privacy notice which is available on www.AssetTracePlus.linkgroup.eu/privacy-policy

    Where you have selected to receive your cash entitlement to your UK bank account/ building society, we may use a third-party provider, ECB, to verify your identity and bank account details. As part of this verification process:
    • A search will be carried out with Experian Ltd for the purposes of verifying your identity and account details;
    • ECB may check the details you supply against any particulars on any database (public or otherwise) to which they (ECB) have access in order to verify your identity; and
    • ECB will retain a record of the search.

    3. These Terms & Conditions and any contractual or non-contractual claim or dispute arising out of or in connection with these Terms & Conditions will be governed by English law. The English Courts will have exclusive jurisdiction and all correspondence will be in the English language;
    4. If any of the provisions of these Terms & Conditions is held invalid, illegal or unenforceable for any reason, such provision shall be severed and the remainder of the provisions in these Terms & Conditions shall continue in full force and effect as if they had been executed with the invalid provision eliminated.
